WAZAMBA - BREACH OF LICENSE
Good morning. I am [EDIT] (user [EDIT]), a Spanish citizen who has filed a claim against the online casino "Wazamba", owned by "Rabidi N.V." and licensed in Curaçao by "Antillephone N.V.".
I am writing to you because in August 2022 i resolved in a favorable way a claim against the casinos "OXI casino", "WINSTORIA" and "DOZEN SPINS", owned by Altacore N.V. and more recently a claim against “Rolling Slots”, owned by “GBL Solutions N.V.” This claim is in the same line of the one I already made at the time:
Neither "Wazamba", nor "Rabidi N.V", nor "Antillephone N.V." are licensed to operate in my country, Spain. Even so, they allow to select "Spain" in the registration, as well as to validate telephones with the prefix " 34" of Spain and to accept Spanish identification documents.
In this case, I claim the total amount of the deposits made, minus the withdrawals, of course. The reason is clear: if "Wazamba" had complied with the legality of both Spain and Curaçao, I could never have deposited money on their platform.
Both, "Altacore N.V." and "GBL Solutions N.V.", are owned by the same group than “Rabidi N.V.”: (SMES) Solutions for Management and Employment Support N.V.
For this to be clearly understood, that’s my legal claim:
-Spain does not appear in the list of prohibited countries, when, according to the legislation of both Spain and the licensing body, "Antillephone N.V.", it should:
• It is the responsibility of the licensee to be familiar with the local laws and requirements for the territories which they intend to offer their services. Before reporting such non-compliance, please make sure the license holder is not operating under multiple licenses, allowing the legal operation in the above regions.
• It also violates what Law 13/2011 on the regulation of gambling in its title II, article 9 point 4 determines: "The enabling titles granted by other States will not be valid in Spain. Operators recognized by other Member States of the European Economic Area must comply with the requirements and with the processing established by current legislation.
