Brazilian industry bodies seek suspension of betting ban pending public hearing

Brazil's National Association of Games and Lotteries (ANJL) and the Brazilian Institute of Responsible Gaming (IBJR) have asked the Supreme Federal Court to suspend the country's betting ban until a public hearing is held. The petition, dated 6 October, is addressed to Justice Luiz Fux in ADI 7721 and seeks suspension of Provisional Measure 1,394/2026.

The central request is to let licensed operators take deposits and bets until hearings take place. The federal government's solicitor general (AGU) asked for new hearings itself, to weigh fresh data from the regulated market, but opposed lifting the ban. The associations counter that if the authorities want more evidence, they should keep the object of that evidence alive. Hearings held after licences are revoked, contracts cancelled and players lost would review a decision already made.

As a fallback the associations propose extending licensed operators through 31 December 2026, with new licence terms starting 1 January 2027. They also want access to authorised platforms restored, their social media accounts returned and transactions permitted through the transition.

New deposits and bets were banned on 25 September, licensed sites were disconnected on 6 October, and federal licences expire on 25 October. ANJL and IBJR warn that removing legal operators will push players faster towards illegal sites. Authorities blocked 10,435 illegal domains between 25 September and 1 October, yet the number of detected illegal platforms rose from 1,195 on 24 September to 1,949 on 6 October.

83 companies paid BRL 2.55bn for 85 five-year licences between January 2025 and March 2026. The measure cancels those licences without refunds or compensation. On 28 September ANJL filed ADI 8027, a direct challenge to the measure.
