Brazil regulator opens public consultation on new betting licensing regulations

Brazil's betting regulator SPA published public consultation notice No. 3/2026 on 27 July to revise operator licensing procedures. Submissions will be accepted for 45 days, closing on 9 September.

The consultation aims to refine licensing rules set out in SPA/MF ordinance No. 827/2024. The revised document will incorporate findings from the first cycle of operator authorisations. Any individual or company can participate through the Brasil Participativo portal using a gov.br account. After the submission period ends, SPA will review contributions in accordance with article 31 of decree No. 12,002/2024.

The procedure review was scheduled for the first quarter of this year under SPA's regulatory agenda (ordinance No. 817, April 2025). The consultation has only now been launched.

The move aligns with the government's push for licensing transparency. In June, Finance Minister Dario Durigan announced the publication of more than 25,000 documents related to bookmaker licensing. This week the Finance Ministry issued administrative order No. 2,126 creating a working group to ensure transparency in gambling company licensing processes.

For operators and affiliate networks in the region, this signals that Brazil's regulator is adjusting the rules as it goes, drawing on initial experience. Those planning market entry or who have already submitted applications should track the consultation outcome — requirements may change.
