Brazil Consumer Secretariat meets to align strategy on betting and illegal operations

Brazil's National Consumer Secretariat (Senacon) held a workshop on online betting oversight on Monday in Brasília. Participants included the Secretariat for Prizes and Betting (SPA), the Secretariat for Digital Rights (Sedigi), the public prosecutor's office, regional consumer protection agencies (Procons), industry self-regulatory bodies and the Brazilian Institute for Responsible Gaming.

The agenda covered the legal framework for betting, the fight against illegal operators and consumer protection. Justice Minister Wellington César Lima e Silva said betting issues go beyond consumer rights and touch on public security. 'This is a matter of public policy. We are seeking to build partnerships with a broad range of Brazilian institutions,' he said.

Senacon head Ricardo Morishita explained the purpose of the meeting: 'We spent the whole day discussing a topic that raises serious concern among consumers. The task is to develop guidance for the consumer protection system so we can combat illegal practices and the shortcomings of unregulated platforms.'

The workshop examined Law 14.790/2023, false and aggressive advertising, evidence collection in investigations, data protection and player behaviour in the digital environment.

In July the justice, finance and social communications ministries issued joint ordinance 73, which sets advertising and marketing rules for betting based on consumer protection law and Laws 13.756/2018 and 14.790/2023. The ordinance applies to operators, advertisers, sponsors and anyone promoting betting through any channel, directly or indirectly. It also governs coordination between SPA, Senacon and Sedigi.
