DrawHouse warns VAT changes could slash prize draw operator margins

HMRC has reversed its position on VAT treatment for prize-draw operators in the UK. Paid entries are now subject to the standard 20% rate, even where a free route is available. Platform provider DrawHouse warns the change will cut operator margins by 25–30%, rising to 35% if VAT is applied directly at the point of ticket sale. Companies that spent years operating on the assumption that free-entry options exempted them from VAT now face material margin compression.

In February, Treasury Secretary Dan Tomlinson confirmed in parliament that paid entries to prize draws fall under the standard VAT rate, including operators that comply with the voluntary regulator code. HMRC has sent letters to several companies, though tax advisers note that current legislation does not clearly support the interpretation. The main risk is retrospective assessment. Many operators reinvested profits into marketing and technology; an unexpected bill covering prior years could undermine business viability.

The Prize Competition Council, an industry body representing over 50 operators, launched in July. DrawHouse calculates that a company with 50% gross margin on an individual draw will still retain margins above those of bookmakers and casinos, where pre-opex margins sit in the single digits or low double digits. Jamie Pinner, commercial director at DrawHouse, said the structural shift creates opportunity for serious players. 'Taxation changes the market, but it does not remove the prospect. Those who build for the new reality will win.'
