Brazil appeals court overturns Stake injunction two days after operator’s return

A Brazilian federal appeals court on October 9 suspended the injunction that allowed Stake Brazil to take bets until October 25. The operator's website and mobile app went offline again on October 10 — two days after they came back.

The ruling came from the Federal Regional Court of the 3rd Region (TRF-3) on an emergency appeal from the Attorney General's Office (AGU). Court president Luis Antonio Johonsom di Salvo said that letting one operator take bets while its competitors are blocked creates unequal conditions. AGU argued that an exception for a single company undermines uniform application of federal measures to the betting market. The judge pointed to the risk of a wave of similar suits from other operators.

The injunction and its terms

The original October 8 decision came from judge Cristiane Farias Rodrigues dos Santos of the 9th Federal Civil Court of São Paulo. It let Stake operate until October 25, 2026, on condition that it keeps user identification checks in place, gives users access to withdrawals and runs no new promo campaigns. Stake's request to work until December 31, 2029, the expiry of its original licence, was rejected.

Provisional measure No. 1394/2026, announced by President Lula on September 25, restricted the operation, offering and advertising of fixed-odds betting. Operators were ordered to stop in early October. The Supreme Court is weighing the measure's constitutionality, but justice Luiz Fux said he would hold his decision until the second round of the presidential election on October 25. Political prediction markets give opposition candidate Flávio Bolsonaro an 87% chance of beating Lula. An LCA Consultores study warns that keeping the ban puts R$73 billion ($14.7 billion) in tax revenue over four years and more than 15,500 jobs at risk.
