President Donald Trump faces a lawsuit filed by The Intercept Media and Freedom of the Press Foundation over Truth API, a service charging traders $60,000 to $100,000 per month for early access to his Truth Social posts. Many of those posts contain policy announcements that move markets.
Truth API launched in early October and has around 10 clients. Trump owns 41% of Trump Media & Technology Group, which operates Truth Social. He transferred the shares to a trust in his son's name before his 2024 inauguration but retains a financial interest.
The plaintiffs describe the arrangement as corrupt and unconstitutional: a sitting president selling official government information through his own company. White House Press Secretary Karoline Leavitt has confirmed that Trump's Truth Social posts represent the administration's official position. Since January 2024 he has published 9,000 to 11,000 posts, many of them the sole source of government news with no parallel release through White House channels.
The suit argues the scheme violates the First and Fifth Amendments by requiring payment for access to official presidential announcements, denying citizens equal access to government information. News outlets that do not subscribe to the API fall behind competitors on speed.
Truth Social previously announced prediction market integration through a partnership with Crypto.com, though the scope of that deal has since been scaled back. The fate of a separate platform, Truth Predict, remains unclear.
