## What it does

The skill handles employment law questions: worker classification, overtime, meal and rest breaks, leave, and final-pay timing on termination. It starts by pinning down the jurisdiction. If you did not name one, it asks — or answers for the state with the most employees and says so.

Rules are not recalled from memory. The skill researches the currently operative rule through a connected legal research tool and cites the controlling statute, regulation or case with a pinpoint cite. Every citation carries a source tag: `[Westlaw]`, `[CourtListener]`, `[web search — verify]`, `[model knowledge — verify]`. A `verify` tag means that citation should be checked first. When a search returns thin coverage for the jurisdiction and question, the skill stops and lays out the options: broaden the query, try another tool, search the web, or flag the question as unverified. A lawyer makes that call.

Back-pay and unpaid-overtime questions get a separate scaffold, because the FLSA regular rate is not the hourly wage. Under 29 U.S.C. §207(e) it is all remuneration except the eight statutory exclusions, so non-discretionary bonuses, commissions and shift differentials count. The skill reads `~/.claude/plugins/config/claude-for-legal/employment-legal/CLAUDE.md` for the company's jurisdictional footprint.

## Install

### Claude Code (native platform)

1. **Skills CLI (Vercel)**
```bash
npx skills add anthropics/claude-for-legal --skill wage-hour-qa -a claude-code
```

2. **Manually: put the files in place**
- File: `~/.claude/skills/wage-hour-qa/SKILL.md` — Copy the whole skill folder; for one project use .claude/skills/wage-hour-qa/

### Codex

1. **Skills CLI (Vercel)**
```bash
npx skills add anthropics/claude-for-legal --skill wage-hour-qa -a codex
```

2. **Manually: put the files in place**
- File: `.agents/skills/wage-hour-qa/SKILL.md` — For all projects use ~/.agents/skills/

### Cursor

1. **Skills CLI (Vercel)**
```bash
npx skills add anthropics/claude-for-legal --skill wage-hour-qa -a cursor
```

2. **Manually: put the files in place**
- File: `.cursor/skills/wage-hour-qa/SKILL.md` — Cursor also reads .agents/skills/ and .claude/skills/

### GitHub Copilot

1. **GitHub CLI**
```bash
gh skill install anthropics/claude-for-legal wage-hour-qa
```

2. **Manually: put the files in place**
- File: `.github/skills/wage-hour-qa/SKILL.md`

### Gemini CLI

1. **Skills CLI (Vercel)**
```bash
npx skills add anthropics/claude-for-legal --skill wage-hour-qa -a gemini-cli
```

2. **Platform CLI**
```bash
gemini skills install https://github.com/anthropics/claude-for-legal --path employment-legal/skills/wage-hour-qa
```

### Windsurf (Devin Desktop)

**Manually: put the files in place**
- File: `.devin/skills/wage-hour-qa/SKILL.md` — The legacy .windsurf/skills/ path still works

### OpenCode

**Skills CLI (Vercel)**
```bash
npx skills add anthropics/claude-for-legal --skill wage-hour-qa -a opencode
```

### Claude.ai

**Claude.ai**
- Zip the folder and upload it in Settings → Capabilities → Skills

Where a file is given instead of a command, copy the files from the source to that path: https://github.com/anthropics/claude-for-legal/tree/HEAD/employment-legal/skills/wage-hour-qa/SKILL.md

## When to use it
- check whether a role meets an exemption from overtime rules
- compute back pay for unpaid overtime including bonuses and commissions
- find out if meal breaks are required and what a missed break costs
- work out final-pay deadlines for termination versus resignation
- see whether accrued PTO has to be paid out

## Example prompts
- /wage-hour-qa do we have to pay overtime for Saturday shifts in California
- /wage-hour-qa what's the rule on rest breaks in Texas
- /wage-hour-qa when is final pay due after termination in New York

  Jurisdiction-aware wage/hour and employment Q&A — classification, overtime,
  meal/rest breaks, leave, final pay — answered for the specific state/country
  with the controlling rule researched and cited rather than stated from
  memory. Use when the user asks any employment law question, or says "what's
  the rule in [state]", "is this exempt", "do we have to pay overtime for",
  or "can we classify this as".
argument-hint: "[question]"

# /wage-hour-qa

1. Load `~/.claude/plugins/config/claude-for-legal/employment-legal/CLAUDE.md` → jurisdictional footprint.
2. Use the workflow below.
3. Identify jurisdiction the question is about. If not specified, ask.
4. Answer per that jurisdiction's rule. Cite. Flag if it's a close call or law is shifting.

---

## Matter context

**Matter context.** Check `## Matter workspaces` in the practice-level CLAUDE.md. If `Enabled` is `✗` (the default for in-house users), skip the rest of this paragraph — skills use practice-level context and the matter machinery is invisible. If enabled and there is no active matter, ask: "Which matter is this for? Run `/employment-legal:matter-workspace switch <slug>` or say `practice-level`." Load the active matter's `matter.md` for matter-specific context and overrides. Write outputs to the matter folder at `~/.claude/plugins/config/claude-for-legal/employment-legal/matters/<matter-slug>/`. Never read another matter's files unless `Cross-matter context` is `on`.

---

## Purpose

"It depends" is true but unhelpful. This skill produces a jurisdiction-specific
answer grounded in researched, cited primary sources — and flags when the
question is close enough to need human judgment. It does not state rules from
memory: wage-and-hour thresholds, exemption criteria, and final-pay timing
change frequently and vary meaningfully by state.

## Load context

`~/.claude/plugins/config/claude-for-legal/employment-legal/CLAUDE.md` → jurisdictional footprint. If the question doesn't specify a
jurisdiction, ask — or answer for the state with the most employees and note
that.

## The answer

### Step 1: Jurisdiction

Which state/country is this about? If not stated:
- If it's about a specific employee: where do they work?
