## What it does

The skill hands the agent a US federal transfer tax frame. Inside is the unified estate/gift/GST system: the lifetime exemption against the annual gift exclusion, the generation-skipping tax, and the filing mechanics of Form 709 and Form 706. The agent can tell when a gift eats into the exemption and when it fits under the annual exclusion.

Portability and DSUE get their own section. The point that matters: moving a deceased spouse's unused exemption requires a timely Form 706, even when no tax is owed. GST exemption does not travel that way, so a family with generation-skipping intent needs trust planning rather than portability alone. The skill also walks the tradeoff between a basis step-up at death and carryover basis on gifts — hold low-basis appreciated assets until death when the estate sits under the exemption, gift them when it does not.

Trusts are covered at advisor altitude: revocable living trust, ILIT, GRAT, IDGT, SLAT, CRT. The author frames this as recognition, not drafting. Annual gifting programs are here too — unlimited direct payments for tuition and medical care, and five-year 529 superfunding. Exemption figures are indexed, so the skill tells you to verify the current year. The text cuts off mid-sentence on charitable remainder trusts, so do not expect that section to be complete.

## Install

### Claude Code (native platform)

1. **Skills CLI (Vercel)**
```bash
npx skills add JoelLewis/finance_skills --skill estate-gifting -a claude-code
```

2. **Manually: put the files in place**
- File: `~/.claude/skills/estate-gifting/SKILL.md` — Copy the whole skill folder; for one project use .claude/skills/estate-gifting/

### Codex

1. **Skills CLI (Vercel)**
```bash
npx skills add JoelLewis/finance_skills --skill estate-gifting -a codex
```

2. **Manually: put the files in place**
- File: `.agents/skills/estate-gifting/SKILL.md` — For all projects use ~/.agents/skills/

### Cursor

1. **Skills CLI (Vercel)**
```bash
npx skills add JoelLewis/finance_skills --skill estate-gifting -a cursor
```

2. **Manually: put the files in place**
- File: `.cursor/skills/estate-gifting/SKILL.md` — Cursor also reads .agents/skills/ and .claude/skills/

### GitHub Copilot

1. **GitHub CLI**
```bash
gh skill install JoelLewis/finance_skills estate-gifting
```

2. **Manually: put the files in place**
- File: `.github/skills/estate-gifting/SKILL.md`

### Gemini CLI

1. **Skills CLI (Vercel)**
```bash
npx skills add JoelLewis/finance_skills --skill estate-gifting -a gemini-cli
```

2. **Platform CLI**
```bash
gemini skills install https://github.com/JoelLewis/finance_skills --path plugins/wealth-management/skills/estate-gifting
```

### Windsurf (Devin Desktop)

**Manually: put the files in place**
- File: `.devin/skills/estate-gifting/SKILL.md` — The legacy .windsurf/skills/ path still works

### OpenCode

**Skills CLI (Vercel)**
```bash
npx skills add JoelLewis/finance_skills --skill estate-gifting -a opencode
```

### Claude.ai

**Claude.ai**
- Zip the folder and upload it in Settings → Capabilities → Skills

Where a file is given instead of a command, copy the files from the source to that path: https://github.com/JoelLewis/finance_skills/tree/HEAD/plugins/wealth-management/skills/estate-gifting/SKILL.md

## When to use it
- work out how much gifting fits under the annual exclusion without touching the exemption
- decide whether to gift appreciated stock now or hold it until death
- elect portability on Form 706 when no estate tax is due
- pick between a revocable and an irrevocable trust for a given goal
- spread a 529 superfunding election over five years and gauge the pullback risk

## Example prompts
- Explain how portability and DSUE work and what has to be filed to claim them
- We want to gift to our kids and grandkids every year — figure out how much moves without using the lifetime exemption
- I hold stock with a low basis: gift it now or leave it until death? Walk both paths

# Estate and Gifting Strategy

## Core Concepts

### The Unified Estate/Gift/GST Framework
Federal transfer taxes operate as one unified system: lifetime taxable gifts and the estate at death draw down a single lifetime exemption, with a flat 40% tax on transfers above it.

- **Lifetime exemption:** $15 million per person effective 2026 under the One Big Beautiful Bill Act (2025), indexed for inflation thereafter — verify the current-year figure. This made the higher exemption permanent and replaced the scheduled TCJA sunset; the pre-2026 planning frame of "use it before it drops to ~$7M" is obsolete. Urgency-driven exemption-use strategies should be re-evaluated on their standalone merits.
- **Annual gift exclusion:** $19,000 per donor per recipient as of 2025, indexed in $1,000 increments — verify the current-year figure. Exclusion gifts consume no lifetime exemption and require no gift tax return if that is the only gifting.
- **Gift-splitting:** Spouses may elect on Form 709 to treat gifts made by either as made half by each, doubling the effective exclusion per recipient ($38,000 per couple per recipient as of 2025). The election applies to all gifts by both spouses that year.
