## What it does

The skill handles the prep work before a deposition. It pulls documents authored by or mentioning the witness from the eDiscovery platform, then lays out the structure: background, key documents, topics tied to the case theory, and impeachment material. Case theory, key facts, and the eDiscovery platform come from `~/.claude/plugins/config/claude-for-legal/litigation-legal/CLAUDE.md`.

There is a hard gate. The matter must appear in `~/.claude/plugins/config/claude-for-legal/litigation-legal/matters/_log.yaml`. If the slug is missing, the skill refuses and routes you to `/litigation-legal:matter-intake` first — the conflicts check is the gate, and it cannot be bypassed. So on a matter that has not been intaken, no outline gets built.

Jurisdiction matters too. For England & Wales and any CPR-governed proceeding, PD 57AC applies: a witness statement must be in the witness's own words, free of argument, list the documents used to refresh memory, and carry the compliance confirmation and the legal representative's certificate. The skill will not draft a narrative statement "as the witness" from a chronology or document set — courts are sanctioning that. Instead it prepares question prompts to elicit actual recollection, captures what the witness says in their own words, generates the list of documents shown, and runs a PD 57AC checklist. US depositions and affidavits follow different rules, but the same discipline holds.

## Install

### Claude Code (native platform)

1. **Skills CLI (Vercel)**
```bash
npx skills add anthropics/claude-for-legal --skill deposition-prep -a claude-code
```

2. **Manually: put the files in place**
- File: `~/.claude/skills/deposition-prep/SKILL.md` — Copy the whole skill folder; for one project use .claude/skills/deposition-prep/

### Codex

1. **Skills CLI (Vercel)**
```bash
npx skills add anthropics/claude-for-legal --skill deposition-prep -a codex
```

2. **Manually: put the files in place**
- File: `.agents/skills/deposition-prep/SKILL.md` — For all projects use ~/.agents/skills/

### Cursor

1. **Skills CLI (Vercel)**
```bash
npx skills add anthropics/claude-for-legal --skill deposition-prep -a cursor
```

2. **Manually: put the files in place**
- File: `.cursor/skills/deposition-prep/SKILL.md` — Cursor also reads .agents/skills/ and .claude/skills/

### GitHub Copilot

1. **GitHub CLI**
```bash
gh skill install anthropics/claude-for-legal deposition-prep
```

2. **Manually: put the files in place**
- File: `.github/skills/deposition-prep/SKILL.md`

### Gemini CLI

1. **Skills CLI (Vercel)**
```bash
npx skills add anthropics/claude-for-legal --skill deposition-prep -a gemini-cli
```

2. **Platform CLI**
```bash
gemini skills install https://github.com/anthropics/claude-for-legal --path litigation-legal/skills/deposition-prep
```

### Windsurf (Devin Desktop)

**Manually: put the files in place**
- File: `.devin/skills/deposition-prep/SKILL.md` — The legacy .windsurf/skills/ path still works

### OpenCode

**Skills CLI (Vercel)**
```bash
npx skills add anthropics/claude-for-legal --skill deposition-prep -a opencode
```

### Claude.ai

**Claude.ai**
- Zip the folder and upload it in Settings → Capabilities → Skills

Where a file is given instead of a command, copy the files from the source to that path: https://github.com/anthropics/claude-for-legal/tree/HEAD/litigation-legal/skills/deposition-prep/SKILL.md

## When to use it
- build a deposition outline for a named witness
- pull witness documents out of the eDiscovery platform
- organize examination topics around the case theory
- surface impeachment material with verified quotes and pinpoints
- run a PD 57AC compliance checklist on a draft witness statement

## Example prompts
- depo prep for Ivanov
- build a depo outline for the witness
- prepare for Petrov's deposition

## Witness statements for England & Wales — PD 57AC

If the user's jurisdiction includes England & Wales and they're asking for a trial witness statement for the Business & Property Courts (or any CPR-governed proceeding), PD 57AC applies. The statement must be in the witness's own words, must not contain argument, must identify the documents the witness used to refresh their memory, and must carry the required confirmation of compliance and the legal representative's certificate.

**Drafting a narrative "as the witness" from a chronology, document set, or your account of the case is exactly what PD 57AC was designed to prevent.** Courts are actively sanctioning AI-assisted witness statement drafting. If you ask me to do it, I won't.

What I WILL do: prepare question prompts to elicit the witness's actual recollection; capture and organize what the witness says (their words, not mine); generate the list of documents they were shown; run a PD 57AC compliance checklist against a statement they've drafted; draft the solicitor's certificate of compliance. I help you get the witness's evidence into the statement. I don't write the evidence.

For US depositions, declarations, and affidavits: different rules, but the same discipline applies. A declaration in the declarant's voice that the declarant didn't write is a credibility problem at best.
