## What it does

The skill takes a proposed mark through a first pass. It asks for the mark, goods or services, classes, jurisdictions and stylization, then checks intrinsic bars: generic, descriptive, deceptive, geographic, surname, false connection, prohibited matter, functional. Then it searches for similar marks through whatever MCP is connected — Solve Intelligence, CourtListener, Descrybe. If nothing is connected, it says so in the output and continues with the factor analysis alone.

Next it walks the likelihood-of-confusion factors for the applicable circuit: du Pont, Polaroid, Sleekcraft. Each factor gets flagged, never concluded. The triage memo lands in the matter folder or the practice outputs folder, with a work-product header set by the user's role.

Before anything runs, the skill reads the practice profile at `~/.claude/plugins/config/claude-for-legal/ip-legal/CLAUDE.md`. If it still holds `[PLACEHOLDER]`, the skill stops and points to `/ip-legal:cold-start-interview`. Say "provisional" instead and it runs on generic defaults — US jurisdiction, middle risk appetite, lawyer role — tagging every block `[PROVISIONAL]`. The skill never concludes a mark is clear. Under-calling a conflict is a one-way door: the logo is already on trucks, the application is filed. So when in doubt it flags, and the attorney decides.

## Install

### Claude Code (native platform)

1. **Skills CLI (Vercel)**
```bash
npx skills add anthropics/claude-for-legal --skill clearance -a claude-code
```

2. **Manually: put the files in place**
- File: `~/.claude/skills/clearance/SKILL.md` — Copy the whole skill folder; for one project use .claude/skills/clearance/

### Codex

1. **Skills CLI (Vercel)**
```bash
npx skills add anthropics/claude-for-legal --skill clearance -a codex
```

2. **Manually: put the files in place**
- File: `.agents/skills/clearance/SKILL.md` — For all projects use ~/.agents/skills/

### Cursor

1. **Skills CLI (Vercel)**
```bash
npx skills add anthropics/claude-for-legal --skill clearance -a cursor
```

2. **Manually: put the files in place**
- File: `.cursor/skills/clearance/SKILL.md` — Cursor also reads .agents/skills/ and .claude/skills/

### GitHub Copilot

1. **GitHub CLI**
```bash
gh skill install anthropics/claude-for-legal clearance
```

2. **Manually: put the files in place**
- File: `.github/skills/clearance/SKILL.md`

### Gemini CLI

1. **Skills CLI (Vercel)**
```bash
npx skills add anthropics/claude-for-legal --skill clearance -a gemini-cli
```

2. **Platform CLI**
```bash
gemini skills install https://github.com/anthropics/claude-for-legal --path ip-legal/skills/clearance
```

### Windsurf (Devin Desktop)

**Manually: put the files in place**
- File: `.devin/skills/clearance/SKILL.md` — The legacy .windsurf/skills/ path still works

### OpenCode

**Skills CLI (Vercel)**
```bash
npx skills add anthropics/claude-for-legal --skill clearance -a opencode
```

### Claude.ai

**Claude.ai**
- Zip the folder and upload it in Settings → Capabilities → Skills

Where a file is given instead of a command, copy the files from the source to that path: https://github.com/anthropics/claude-for-legal/tree/HEAD/ip-legal/skills/clearance/SKILL.md

## When to use it
- check a new mark before filing an application
- find similar marks across connected databases
- work through confusion factors for your circuit
- write a flag list into a memo for counsel
- screen out descriptive and geographic marks

## Example prompts
- /ip-legal:clearance "APEXLEAF for an outdoor apparel line, planned launch US + EU"
- /ip-legal:clearance
- Run the knockout check on this mark and show me the flags

# /clearance

**This is a triage, not a clearance opinion.** A trademark clearance opinion
requires a full professional search and registered trademark counsel's
judgment. A "no obvious conflicts" result means the triage
didn't find anything — it does not mean the mark is clear. Clients have been
sued over marks that passed a knockout search.

## Instructions

1. Read `~/.claude/plugins/config/claude-for-legal/ip-legal/CLAUDE.md`. If it
   contains `[PLACEHOLDER]`, stop and direct to `/ip-legal:cold-start-interview`.
2. Follow the workflow below.
3. Run intake (mark, goods/services, classes, jurisdictions, visual/stylization).
4. Knockout check for intrinsic bars — generic, descriptive, deceptive,
   geographic, surname, false connection, prohibited matter, functional.
5. Similar-marks search against what's connected (Solve Intelligence, CourtListener, Descrybe, or whatever MCP is available). If nothing is
   connected, say so in the output and proceed with the factor analysis only.
6. Walk the applicable circuit's likelihood-of-confusion factors — du Pont /
   Polaroid / Sleekcraft / other. Flag each; never conclude.
7. Write the triage memo to the matter folder (if a matter is active) or the
   practice outputs folder. Apply the work-product header per role.
8. End with recommended next steps and the non-lawyer gate if the role is
   non-lawyer.

This skill never concludes a mark is clear. If uncertain, flag — the attorney
decides.

## Examples

```
/ip-legal:clearance "APEXLEAF for an outdoor apparel line, planned launch US + EU"
```

```
/ip-legal:clearance
```

(And the skill will ask for the mark, goods, classes, and jurisdictions.)
