## What it does

The skill builds a patent-claim draft from the project materials. It uses `patent/INVENTION_DISCLOSURE.md`, `patent/PRIOR_ART_REPORT.md`, and `patent/NOVELTY_ASSESSMENT.md`; the target jurisdiction can come from the disclosure or the launch argument. The workflow covers independent method and system claims, followed by dependent claims that add narrower technical limitations.

Claim form changes by jurisdiction. CN and EP use a two-part structure, while US drafting uses an open transition with `comprising`. The skill also applies numbering rules, checks antecedent references, and keeps empirical results out of claim limitations. Its reference files cover general patent-writing principles plus CN, US, and EP formats.

The configuration allows up to `3` revision rounds, sets `2` as the minimum number of independent claims, and limits the total to `20`. A `utility_model` has a strict boundary: the draft may contain apparatus or device claims only, with no method claims.

## Install

### Claude Code (native platform)

1. **Skills CLI (Vercel)**
```bash
npx skills add wanshuiyin/Auto-claude-code-research-in-sleep --skill claims-drafting -a claude-code
```

2. **Manually: put the files in place**
- File: `~/.claude/skills/claims-drafting/SKILL.md` — Copy the whole skill folder; for one project use .claude/skills/claims-drafting/

### Codex

1. **Skills CLI (Vercel)**
```bash
npx skills add wanshuiyin/Auto-claude-code-research-in-sleep --skill claims-drafting -a codex
```

2. **Manually: put the files in place**
- File: `.agents/skills/claims-drafting/SKILL.md` — For all projects use ~/.agents/skills/

### Cursor

1. **Skills CLI (Vercel)**
```bash
npx skills add wanshuiyin/Auto-claude-code-research-in-sleep --skill claims-drafting -a cursor
```

2. **Manually: put the files in place**
- File: `.cursor/skills/claims-drafting/SKILL.md` — Cursor also reads .agents/skills/ and .claude/skills/

### GitHub Copilot

1. **GitHub CLI**
```bash
gh skill install wanshuiyin/Auto-claude-code-research-in-sleep claims-drafting
```

2. **Manually: put the files in place**
- File: `.github/skills/claims-drafting/SKILL.md`

### Gemini CLI

1. **Skills CLI (Vercel)**
```bash
npx skills add wanshuiyin/Auto-claude-code-research-in-sleep --skill claims-drafting -a gemini-cli
```

2. **Platform CLI**
```bash
gemini skills install https://github.com/wanshuiyin/Auto-claude-code-research-in-sleep --path skills/claims-drafting
```

### Windsurf (Devin Desktop)

**Manually: put the files in place**
- File: `.devin/skills/claims-drafting/SKILL.md` — The legacy .windsurf/skills/ path still works

### OpenCode

**Skills CLI (Vercel)**
```bash
npx skills add wanshuiyin/Auto-claude-code-research-in-sleep --skill claims-drafting -a opencode
```

### Claude.ai

**Claude.ai**
- Zip the folder and upload it in Settings → Capabilities → Skills

## When to use it
- draft independent method and system claims
- turn invention features into dependent fallback claims
- account for prior art and novelty amendments
- adapt claim structure to CN, US, or EP practice
- keep claim numbering and antecedent references consistent

## Example prompts
- Draft patent claims from `patent/INVENTION_DISCLOSURE.md`.
- Prepare US claims using `patent/PRIOR_ART_REPORT.md` and `patent/NOVELTY_ASSESSMENT.md`.
- Rewrite the draft for CN as a `utility_model` application.

# Claims Drafting: The Core Patent Skill

> **Before each reviewer slot**, follow [Selectable Reviewers](../shared-references/reviewer-backends.md):
> resolve invocation → `.aris/reviewer.json` → Claude Code default (Codex MCP)
> with `reviewer_route.py` through the canonical helper resolver, preserving this
> slot's tier, fresh contexts, source/image inputs and deterministic gates.
> Codex examples/pins below apply only to `backend=codex`; other routes use their
> own first-call/reply contract. Save the route and actual returned identity;
> unavailable selections are `REVIEW_UNAVAILABLE`. Classify acceptance from actual

Draft patent claims based on: **$ARGUMENTS**

This is the most critical skill in the patent pipeline. Claims define the legal scope of protection -- everything else (specification, figures, abstract) exists to support and enable the claims.

## Constants

- `REVIEWER_MODEL = gpt-6-astra` — External examiner for claim quality review
- `MAX_CLAIM_REVISION_ROUNDS = 3` — Maximum revision iterations
- `CLAIM_STYLE = "auto"` — `US` (Jepson or open), `EP` (two-part mandatory), `CN` (two-part), `auto` (detect from jurisdiction)
- `MIN_INDEPENDENT_CLAIMS = 2` — Typically method + system. For utility model (实用新型): apparatus/device only, NO method claims.
- `MAX_TOTAL_CLAIMS = 20` — Practical limit (USPTO includes 20 in base fee)
- `PATENT_TYPE = "invention"` — `invention` (发明专利) or `utility_model` (实用新型, apparatus claims only)

## Inputs

1. `patent/INVENTION_DISCLOSURE.md` — structured invention with core/supporting/optional features
2. `patent/PRIOR_ART_REPORT.md` — prior art to avoid
